In-House Counsel

Location: Spartanburg, SC | Full-Time | Fully Onsite

About the Role:

Counsel will support the Legal Department and business needs for a growing automotive finance company with a national footprint. This position will expose the candidate to many aspects of the consumer finance and commercial lending industries, including regulatory compliance and business transactions, with opportunities for advancement in these and other areas. 

 

About the Team :

Our Legal Department provides guidance and support in a broad range of complex issues, including federal and state consumer protection laws, litigation, transactional matters, contracts, corporate governance, and many others.

 

What You’ll Do:  

Below are examples of potential responsibilities for the Counsel position:

 

  • Support and maintain ACA’s Business Licensing Platform
    • Prepare and review business license filings with Analyst support
    • Ensure timely processing and receipt of business license renewals
    • Research and apply for new business licenses, depending on business need
  • Provide legal support and guidance for escalated consumer complaints
    • Review, analyze, and draft responses to escalated consumer complaints
    • Communicate with management and external parties regarding complaints
    • Incorporate management feedback into draft responses and respond to follow up requests
  • Support ACA’s Regulatory Examination Process
    • Review, analyze, and prepare responses to exam information requests
    • Partner with business and data teams to produce thorough and accurate responsive materials
    • Interact with regulators and provide guidance to business relating to examination findings
  • Participate in industry activities
    • Attend industry trade association meetings, webinars, and conferences
    • Establish and maintain a network of industry contacts
    • Research and analyze legal developments to determine applicability and impact to ACA’s business operations
  • Support ACA’s Compliance Management System
    • Facilitate meetings with business leaders regarding regulatory compliance matters
    • Provide legal review and guidance relating to policies, procedures, training content, compliance monitoring, and template forms and communications
    • Respond to business questions about operational practices and compliance with laws
  • Research various federal and state laws to ensure regulatory compliance, including:
    • Truth-in-Lending Act
    • Equal Credit Opportunity Act
    • Fair Credit Reporting Act
    • Fair Debt Collection Practices Act (and state debt collection laws)
    • Federal and state laws restricting unfair or deceptive acts or practices
    • Gramm-Leach-Bliley Act and other federal and state privacy and information security laws
    • Federal and state laws governing the use of artificial intelligence
    • Telephone Consumer Protection Act
    • State retail installment sales acts
    • State uniform commercial codes
    • State certificate of title acts
    • Bankruptcy and creditor’s rights laws
  • Develop and maintain 50-state legal surveys on various topics with Analyst support
  • Other tasks as assigned

  What You Bring:  

  • Candidate must have excellent attention to detail and analytical skills, a strong sense of organization, and an ability to communicate clearly with internal and external parties
  • Must be a team player and able to work both independently and as part of a group
  • Computer skills should include Microsoft Office, Windows, and the internet
  • Bachelor’s and Juris Doctor degrees required, successful completion of bar examination and active law license in at least one jurisdiction required
  • Entry-Level to Early Career Attorney  (0-3 years of experience)

Position Details  

  • Must be able to commute to the office five days a week.
  • Relocation: Open to candidates willing to relocate. Position requires relocation to Spartanburg, SC by start date.
